General Terms and Conditions for orders to Schober Addresses ONLINE (as per: 01/2006)
1. General information
These General Terms and Conditions are integral to our provision of services and contracts with our customers regarding the supply of addresses by means of the application Schober Addresses ONLINE and also apply to future businesses with the same. They apply exclusively to businesses with companies in the sense of § 14 BGB (German Civil Code). The person referred to as "entrepreneur" or "merchant" in these General Terms and Conditions is equivalent to a legal entity in public law and responsible for special assets under public law. These General Terms and Conditions do not apply to business with consumers in the sense of § 13 BGB (German Civil Code). These General Terms and Conditions replace any other General Terms and Conditions, unless a different contractual agreement has been expressly made with the customer. We do not agree to the purchaser's conditions , even if we do not expressly object to them.
2. Use of the addresses
2.1 The addresses supplied by us are subject to the Databank Copyright Protection in accordance with § 87 UrhG (German Copyright Act); they may only be used to the agreed extent. When using the address details made available it is the customer's responsibility to comply with the legal regulations , in particular those regarding Data Protection, on his own liability.
2.2 Unless otherwise agreed all the addresses made available are for the customer's own use for direct advertising promotions. Their use is limited to 12 months from the date of download. Any sale or transfer for use by third parties is prohibited; we reserve the right to assert claims for damages. It is sufficient to present one of the test addresses which are included in the address groups to provide evidence.
2.3 The addresses of persons or enterprises responding to the customer's advertising by ordering or requesting information, with the exception of those taking part in competitions, are not subject to any limitations as far as further uses by the customer are concerned.
3. Returns
Despite our address records being updated and revised continually, due to the fluctuation within address groups we cannot guarantee to the customer at the time of delivery that all postal addresses are accurate, that the target groups are complete or that all additional details are correct. As we gather the addresses from public records, directories and details provided by individuals in surveys, we cannot guarantee that an addressee is or still is what he purported to be or was purported to be by third parties at the time the data was gathered. For this reasons returns (refusals) are inevitable and cannot be considered to be a deficiency in the object of delivery. Consequently, unavoidable returns will not be reimbursed.
4. The right of the customer in the case of deficiencies; Liability
4.1 Ascertainable deficiencies established after reasonable investigation by the customer must be communicated in writing without delay (as per § 377 HGB (German Commercial Code) after download of the data. If the customer fails to comply with the applicable deadline, this is his responsibility and he may assert no claims against us for deficiencies.
4.2 Even if the customer makes use of the addresses at a later date, this does not release him from the obligation to carry out a reasonable inspection on the material supplied immediately on delivery.
4.3 If we receive notification of deficiencies within the stipulated period, we are obliged either to make a replacement delivery or rectify (take remedial action) at our discretion. The customer must provide us time and opportunity to do so. If the remedial action fails, the customer may accept a price reduction or withdraw from the contract.
4.4 Liability for consequential damages caused by deficiencies is excluded, unless the damage was caused intentionally or grossly negligently. In the event of negligent breach of contract, our liability is limited to direct, foreseeable losses that are typical for this type of contract. The latter sentence shall not apply when there is a breach of important contractual obligations. Claims for deficiencies in the delivery come under the statute of limitation twelve months after the date of the download.
5. Applicable law
The mutual legal relationship shall be governed solely by the laws applicable in the Federal Republic of Germany. If the customer is resident outside Germany, this applies including the United Nations Convention on Contracts for the International Sale of Goods (CISG).
6. Place of fulfilment; place of jurisdiction
Place of fulfilment for all obligations towards us is Ditzingen near Stuttgart/Germany. Place of jurisdiction for all legal disputes is Stuttgart, unless the law stipulates that there is no one exclusive place of jurisdiction.

These data protection guidelines are to inform you what data we record, how we use it and under what circumstances we pass it on.
1. Registration data
All customer details are treated in line with the BDSG [Federal German Data Protection Act] and the TMG [Teleservices Data Protection Act] When you register in the application , for instance, in order to store your address count permanently, or to order data, you are requested to provide certain details, including your name, e-mail address and postal address. All these details are only used for the purposes of your order and in order to keep you informed about the status of your order. If you choose to pay by credit card, during the process we require the credit card number and the expiry date – however, this data is not stored. All the information you enter is protected by the SSL encryption process. SSL encodes the data transferred in such a way that it is unreadable by third persons who might try to intercept it. Further details entered when you register are voluntary and help us to optimise our services to you. Only after the commencement of a business relationship may you possibly receive from us further relevant information, and you are free at any time to reject this information being sent to you. You are entitled to receive at any time free of charge information about your details stored with us or to have them deleted - please inform us by post, fax or e-mail at: datenschutz@schober.de
2. Disclosure of personal details to third parties
We use your personal details solely to process your order or for business contact with you. Consequently. we do not pass on data to third parties. Exceptions are only permitted in an official enquiry, to comply with legal regulations or in order to defend our copyright or other rights. We take the appropriate technical and organisational steps to protect the information we have been entrusted with from unauthorised access.
3. Visitor details
When you visit our website , your browser transmits your IP address to our web server. We record this and the activities that are carried out from your computer in our application. This information is passed on solely in the event of misuse of data supplied by us, if necessary to the law enforcement agencies.
We may use your IP address during your visit to look for information on your company in public databanks which helps us to optimise the services we offer. Any information established in this process is used exclusively in line with the German laws on personal data. Naturally, no information on you as a private individual is searched for nor stored.
4. Cookies and 1-Pixel-GIFs
We use cookies to make navigation easier if you visit our website again, eg: in case you close the browser window by mistake. A cookie is a small data file which is sent via your browser and stored on your computer's hard disk. A cookie cannot read data from your hard disk, nor damage your computer system. In the browser configuration you can decide yourself whether to accept cookies. If you reject cookies, you may not be able to use the full functions offered by our or other websites. We employ single-pixel graphics for statistical purposes. These small, invisible graphic data files cannot cause any damage. Their purpose is to analyse visitor behaviour within the application and so optimise our services. No information on you as a private individual is gathered.
